1. Acceptance of Terms
By accessing or using the Eat Mubarak website and platform (collectively, the “Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms in their entirety, you must not use the Service. These Terms constitute a legally binding agreement between you and Eat Mubarak (“we,” “us,” or “our”).
We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We will note the effective date at the top of this page when changes are made.
2. Description of Service
Eat Mubarak is an online marketplace that connects customers seeking halal catering services with independent caterers, chefs, and restaurants (“Caterers”). We do not ourselves prepare, handle, or deliver food. All catering services are provided directly by independent third-party Caterers who list their offerings on our platform.
Eat Mubarak acts solely as an intermediary to facilitate the discovery and ordering process. We are not a party to any contract for catering services entered into between a Customer and a Caterer.
3. User Accounts & Eligibility
You must be at least 18 years of age and capable of entering into a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements.
Caterers must register for a portal account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account at hi@eatmubarak.com.
We reserve the right to suspend or terminate any account at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, Caterers, or the Service.
4. Orders, Payments & Deposits
All prices displayed on the Service are estimates provided by individual Caterers and are subject to confirmation by the Caterer at the time of booking. A non-refundable deposit of 25% of the estimated total is required to secure a catering reservation unless otherwise agreed in writing.
Payment processing is handled by third-party payment providers. Eat Mubarak is not responsible for errors, failures, or disputes arising from payment processing. Prices displayed on the platform include applicable sales tax estimates; final tax amounts are determined at checkout or by the Caterer.
Eat Mubarak charges a platform service fee on orders placed through the Service. This fee is subject to change at any time with or without notice.
5. Cancellations & Refunds
Cancellation and refund policies are set by each individual Caterer and will be communicated to you at the time of booking. Eat Mubarak does not guarantee any refund on behalf of a Caterer.
As a general guideline, cancellations made more than 72 hours before the event may be eligible for a partial refund at the Caterer's discretion. Cancellations made within 72 hours of the event are generally non-refundable. Deposits are non-refundable unless the Caterer cancels the order.
Eat Mubarak is not liable for any losses, damages, or expenses arising from cancellations by either a Customer or a Caterer.
6. Halal Certification & Food Safety
Eat Mubarak lists caterers that represent themselves as providing halal food. We make reasonable efforts to promote halal compliance; however, we do not independently verify, certify, audit, or guarantee the halal status of any food prepared or served by Caterers listed on our platform.
Customers with specific dietary, allergen, or religious requirements are solely responsible for verifying the suitability of the food with the Caterer directly before placing an order. Eat Mubarak shall not be held liable for any claim arising from the food not meeting a Customer's dietary or religious requirements.
Caterers are responsible for complying with all applicable food safety laws, regulations, and licensing requirements in their jurisdiction.
7. Caterer Obligations
By listing on Eat Mubarak, Caterers agree to:
- Provide accurate, up-to-date information about their menu, pricing, availability, and service area.
- Fulfill all confirmed orders in a professional and timely manner.
- Hold all required local, state, and federal food-handling licenses and permits.
- Maintain adequate commercial liability insurance.
- Communicate promptly with customers regarding order changes, delays, or cancellations.
- Comply with all applicable laws and regulations, including those governing food preparation, labeling, and delivery.
Eat Mubarak reserves the right to remove any Caterer from the platform at any time for any reason, including but not limited to poor performance, negative customer feedback, or failure to meet these obligations.
8. Intellectual Property
All content on the Service — including but not limited to text, graphics, logos, images, and software — is the property of Eat Mubarak or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our express written permission.
By submitting content (including photos, menu descriptions, and reviews) to the Service, you grant Eat Mubarak a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, display, reproduce, and distribute that content in connection with the Service and our marketing materials.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Eat Mubarak, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, loss of data, food-related illness, property damage, or personal injury — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the greater of (a) the amount you paid to Eat Mubarak in the 90 days preceding the claim, or (b) $100 USD.
10. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Indemnification
You agree to indemnify, defend, and hold harmless Eat Mubarak and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any food-related claims, injuries, or disputes arising from catering services you provided or received through the Service.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in New Jersey, on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Privacy & SMS / Email Communications
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
SMS & Email Consent. By providing your phone number or email address and submitting an order or inquiry through the Service, you expressly consent to receive transactional and informational messages from Eat Mubarak via SMS/text message and email. These messages may include order confirmations, booking updates, payment receipts, and other communications related to your use of the Service.
Message Frequency. Message frequency varies depending on your activity on the platform. You may receive up to several messages per order or inquiry (e.g., confirmation, caterer acceptance, reminders, and follow-up).
Message & Data Rates. Message and data rates may apply. Please check with your mobile carrier for details about your plan.
Opt-Out. You may opt out of SMS communications at any time by replying STOP to any text message you receive from us. To opt out of marketing emails, use the unsubscribe link included in any such email. Opting out of transactional messages (such as order confirmations) may not be possible while an active order is in progress.
Non-Sharing of Mobile Numbers. We will not share, sell, rent, or otherwise disclose your mobile phone number to any third party for their independent marketing purposes. Your mobile number is used solely to send you communications related to your use of the Eat Mubarak platform and will not be provided to advertisers or unaffiliated third parties.

14. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any applicable Caterer agreements and our Privacy Policy, constitute the entire agreement between you and Eat Mubarak regarding your use of the Service and supersede all prior agreements.
